Exclusive Terms and Conditions
Orders are accepted and placed only upon written acknowledgement of the order and are subject to the following terms and conditions in lieu of any contrary provisions that may be included.

Quotations
OZ Merchandising Inc. is pleased to provide price and delivery quotations by email or fax. An email sent to the Sales Manager stating the specific items, as set out below, is requested. A quotation will be sent by email.

Placing an Order
Please state the Model Number, colour, quantity by size. For numbering, the numbers by size are required as well as ink colour and placement on the shirt.

Orders can be placed by telephone at (613) 831-3121, fax at (613) 831-1880 or via email to the attention of the Sales Manager as listed on the Contact us page of our website www.ozmerch.com.

Necessary Information
OZ Merchandising Inc. requires the following details from our customers before any order can be: Customer name, customer address, telephone number and a valid email address.

Pick Up
Every effort will be made to process your order expeditiously and to meet your desired delivery schedule. However, OZ Merchandising Inc. shall have no liability for any delays in delivery. Orders are usually deliverable within 2-3 weeks dependant upon the size of the order, availability by the supplier and the amount of screen-printing work to be provided. All orders are to be picked up at the OZ Merchandising Office located at 221 Westbrook Road, Ottawa, Ontario, K0A 1L0.

Payment
All sales include applicable taxes and are payable in Canadian Dollars. All orders are to be paid IN FULL upon pickup. A deposit may be requested when the order has been placed with the supplier. Payment for purchases can be made to OZ Merchandising Inc. by company cheque (on approved credit) in dollars drawn on a Canadian Bank ONLY. We also accept money orders, debit and credit card payments. Our payment terms are payment in full upon receipt of the items. An interest charge at the rate of 1.5% per month may be charged for late payments. If you account is greater than 90 days past due, additional collection fees equal to but not more than 50% of your outstanding balance (including applicable interest charges) may be charged plus any applicable legal fees.

To change Orders
Orders cannot be changed after the supplier has been notified of the order. Before then, Change requests may be faxed or emailed to the Sales Manager. The original quote number, order date and delivery date are required.

Cancellations
We cannot accept cancellations of custom orders already in production. Undelivered custom orders are subject to a cancellation fee, which shall cover a reasonable estimate of materials and work already expended by OZ Merchandising Inc. Cancellation of an order must be submitted in writing by mail, email or fax to OZ Merchandising Inc. The date on which the cancellation notice is received will dictate the conditions to be applied.

Limited Warranty
The supply of products through OZ Merchandising Inc. will be subject to the warranty provided by the manufacturer.

General
Neither party will be liable for any delay in performance resulting from any cause beyond that party's control (including without limitation to material and/or capacity shortages). If any sentence, part, or provisions of these terms and conditions shall be found illegal, unenforceable, or in conflict with any valid controlling law, the validity of the remaining terms and conditions shall not be affected thereby. Each party shall conform to all applicable laws and regulations, including but not limited to export control laws of the United States, Canada, or any other applicable jurisdiction. These terms and conditions shall be construed in accordance with the substantive laws of the Province of Ontario, without regard to its conflict of laws rules, except that questions affecting the intellectual property rights shall be determined by the laws under which such rights are granted, registered, or protected. No waiver of any of the foregoing terms and conditions shall be effective unless made in writing and signed by the party sought to be bound to such waiver.
